Automatic openers - Manufacturer's warranty terms   

Subject to all of the matter set out below, Automatic Technology Australia Pty Ltd (“ATA”) WARRANTS for twenty four (24) months from the date of purchase (specified in the receipt sales docket) that the Garage Door Opener System contained in the accompanying packaging (the “Product”) is free of any defects in material and workmanship rendering it unmerchantable.

This warranty referred to above applied only where:

a) the consumer seeking to rely on the said warranty;

1) returns the Product which it claims to be defective; and 
2) presents the relevant sales docket and this warranty document,

To the retailer from whom the Product was purchased to confirm that date of purchase; and

b) the purchaser notified ATA or the retailer from whom the Product was purchased of the alleged defect in the Product immediately upon experience or learning of the alleged defect.

 
 
   
 

Except for the warranty against defects in material and workmanship set out above, ATA gives no warranties of any kind whatsoever, whether express or implied or whether statutory or at common law, in relation to the Product, and all warranties of fitness for particular purpose and other warranties of whatsoever kind relating to the Product are hereby declaimed. Without limiting the generality of the foregoing, ATA disclaims any liability of whatsoever nature in respect of any claim or demand loss or damage which arise out of;

a) accidental damage to or normal wear and tear to the Product or to the Product’s components;

b) flood, rain, water, fire or lightning;

c) incorrect, improper or unreasonable maintenance and/or use;

d) installation, adjustment or use other than ATA which is not in accordance with the instructions set out in installation instructions incorporated in the document;

e) attempted or complete modification or repairs to the Product carried out by a person who is not authorised by ATA to carry out such modification or repairs;

f) faulty or unsuitable wiring of structure to which the Product is fixed or connected; and

g) radio (including citizen band transmission) or any electronic interference.

h) blown fuses or damage caused by electrical surges.

i) damage caused by insects.


ATA’s liability under the warranty set out above is limited, at ATA’s absolute option, to replacing or repairing the Product which ATA, in its unfettered opinion, considers to the defective either in material and/or workmanship or to credit the consumer with the
price at which the Product was purchased by the consumer.

Where the Product is retailed by any person other than ATA, except for the warranty set out above, such person has no authority from ATA to give any warranty or guarantee on ATA’s behalf in addition to the warranty set out above.

IN-WARRANTY SERVICE
During the warranty period, if the product appears as though it may be defective contact Tilt-A-Dor Ltd.

   

Merlin Garage Openers Ltd and Merlin Garage Openers Pty Ltd (hereinafter referred to as Merlin) warrants to the original purchaser ("the Buyer") that the Merlin garage opener ("the Unit") sold under this warranty will be free from defects in material and workmanship for a period of 24 months from the date of purchase.

Accordingly if the unit fails due to defects in material or workmanship within the warranty period Merlin will, provided the defective part or unit is returned freight and insurance prepaid and well packaged to Merlin UK Ltd, undertake to repair or, at its option replace, any defective part or unit and return it to the buyer at no cost. Repairs and replacement parts are warranted for the remaining portion of the original warranty period.

 
LIMITED WARRANTY ON MOTOR.
After 24 months and through to 60 months, Merlin will furnish a replacement motor if it is found to be defective; free of charge. Labour costs will be charged.

Where the Unit has been installed by Tilt-A-Dor Ltd, Merlin will furnish replacement parts free of charge through Tilt-A-Dor Ltd.  Tilt-A-Dor Ltd will apply a call out and labour charge for any repair work carried out.

LIMITATIONS. The warranty expressly excludes any batteries or light bulbs and malfunctions or defects to the Unit or its operation due to any of the following:

A    Failure to observe installation, adjustment, maintenance or operating instructions provided with the Unit;

B    Incorrect installation, operation or adjustment of the garage door to which the Unit is fitted;

C    Connection to any garage door outside the specifications set out in the owners manual;

D    Any modification or repair to the Unit carried by a person not authorised to do so by Merlin;

E    Radio or any other electrical or electronic interference;

F    Faulty or unsuitable electricial wiring of the building to which the Unit is attached;

G    Faulty or flat batteries in the remote control transmitter;

H    Where the defect is due to: conditions other than normal domestic use or dirt, misuse, neglect, fire, accident, electrical storm or other act of God.


This warranty is void if the serial number has been altered, defaced or moved.
The Liability of the Distributor for any loss or damage or injury arising directly or indirectly from any defect in the goods supplied is limited to the replacement or repair of such goods or to damages not exceeding the invoice value of such goods at the option of Merlin.

FUTURE MODIFICATIONS. Merlin may modify any existing or future model of the Unit without the obligation to incorporate these modifications into Units already manufactured or into the Unit to which this warranty applies.

GENERAL. This warranty is the only Warranty made by Merlin. All other warranties, representations and conditions of any kind, express or implied, are hereby excluded. Nothing in this warranty is intended to have the effect of contracting out of the provisions of the law expect to the extent provided by that law and all provisions of this warranty shall be read and modified to the extent necessary to give effect to that intention. This warranty does not deprive the Buyer of any rights conferred upon them by any applicable law or statute in their country of purchase 
Proof of date of purchase may be required when making a claim under warranty. In the event that the Buyer is unable to provide adequate proof of purchase the date of the warranty will apply from the date of shipment from the Distributor to the Reseller.

NOTE. We request that you attach your sales docket or invoice to the product manual to enable you to establish the date of purchase in the unlikely event of a service call being made.
